A gestational carrier has no genetic connection to the baby. Through ‘gestational surrogacy’, she carries a pregnancy via an embryo created through in vitro fertilization (IVF) using the intended parents’ egg and sperm or using donor egg or sperm. On the other hand, a traditional surrogate provides her own egg and carries a pregnancy using the intended father’s sperm or donor sperm. Therefore, she has a genetic link to the baby. As RESOLVE points out, “due to various legal reasons, this family building option is not as common or recommended as frequently as gestational surrogacy typically would be”. Many states even prohibit traditional surrogacy.
When you’re sure that surrogacy is the right path for you, it’s time to decide on a surrogacy agency to support you along the way. Timeline: 1-3 monthsIf you haven’t yet, at this stage you’ll create your embryos (using an egg from the intended mother or a donor and sperm from the intended father or a donor). Timeline: A typical IVF cycle takes 4 weeks if you already have an egg/sperm donor.You will be asked to complete an intended parent profile, including facts about you, your family, your story, and what you are looking for in a gestational carrier. This helps the agency get to know you and learn more about what you’re hoping for in a journey and in a surrogate match. The agency then helps find the most ideal match that meets your criteria and the gestational carrier’s requirements. (As a note, the gestational carrier undergoes a prescreening, a Social Work Consultation and a psychological exam with a licensed professional). Profiles are exchanged and both of you will determine if you’d like to move forward and work together.
Timeline: 3-7 monthsThe gestational carrier undergoes a thorough medical screening including a physical exam, a sonohysterogram to evaluate the uterus and ovaries, and blood tests to check for undiagnosed medical conditions or infectious diseases. Her medical and surgical history, including family and pregnancy history is also reviewed.
Timeline: 1 monthOnce the gestational carrier is medically and psychologically cleared, you can move on to the contract stage. Both parties to the contract have their own independent lawyer. Timeline: 1 monthThe fertility clinic provides the gestational carrier with her protocol and medication. When it’s time for the embryo transfer, you can either join in person or via a video call. Next up is the two week wait - the time between the embryo transfer and hCG level blood test. The gestational carrier visits a local clinic for beta tests until the heartbeat is confirmed.
Timeline: Up to 20 daysDuring the early stages, the gestational carrier continues to be monitored by a fertility clinic close to her home until she’s released to an OBGYN of her choice. The gestational carrier updates you as the pregnancy progresses. Depending on the state, your attorney may be able to start the pre-birth order process around 16-20 weeks. At this stage, you start working on a birth plan, book any travel, choose a pediatrician, and start preparing for the baby!
Timeline: 9 - 10 monthsCongratulations! It’s time to welcome your little one. Court proceedings start before or after the birth, depending on state law. An order or judgment declares the intended parents as parents of the child. International parents stay in the country until a passport is issued.
